About Pan Mohamad Faiz, S.H., M.C.L., Ph.D.

Pan Mohamad Faiz was born in Jakarta, Indonesia. He earned his PhD on Constitutional Law at the TC Beirne School of Law, the University of Queensland in Brisbane, Australia. Faiz has been working as a Researcher, Judicial Assistant and Speechwriter at the Indonesian Constitutional Court since 2005. He has a Bachelor of Laws degree from the University of Indonesia and Master of Comparative Laws degree, concentrating in comparative constitutional law, from the University of Delhi where he was fully supported by ICCR Scholarship. He has been invited to be a guest lecturer on constitutional law at the Faculty of Law, University of Indonesia and other Indonesian legal institutions since 2008. He was the Executive Secretary of the Expert Council of Indonesian Legal Scholars Association (ISHI) and a Legal Researcher at the Institute of Indonesian Law and Governance Development (IILGD) and at the Legal Center for Law and Information (The CeLI). In 2012 he became a Research Scholar at the Centre for Public, International and Comparative Law (CPICL) and commenced his PhD at TC Beirne School of Law, the University of Queensland. Early 2012 the U.S. Department of State awarded Faiz a premier professional exchange program known as the International Visitor Leadership Program (IVLP) for his outstanding achievement and contribution. Despite his achievement in academic area, Pan Mohamad Faiz is well known as a student activist both in national and international level. He was the President of Student Senate at Faculty of Law, University of Indonesia (2004-2005) and the President of Indonesian Student Association in India/PPI-India (2007-2008). He is also one of the founders of “Forum Lintas Generasi (FLG, Depok), Overseas Indonesian Students Association Alliance (OISAA, Sydney), and Institute of Indonesian Law and Governance Development (IILGD, Jakarta). Faiz also served as National President of Indonesian Students Association of Australia (PPI Australia) and Coordinator of Overseas Indonesian Students Association Alliance (PPI se-Dunia).

MENYOAL BAHASA PIDATO RESMI PEJABAT NEGARA: ANALISIS BERPERSPEKTIF HUKUM

1. Pendahuluan

“Quot linguas quis callet, tot homines valet”. Demikian pepatah latin mengatakan untuk menunjukkan bahwa semakin fasih seseorang berbicara dalam berbagai bahasa maka dengan sendirinya pergaulannya akan lebih luas. Di era modernisasi dengan tren globalisasi yang kini hampir tak memiliki ruang dan batas antarnegara (borderless), bahasa dipercaya menjadi elemen perekat dan medium komunikasi yang paling efektif antara satu bangsa dengan bangsa lainnya.

Indonesia yang kembali menggeliat maju dari rahim reformasi senantiasa berupaya untuk bersaing dengan negara-negara lain baik di pentas regional maupun internasional. Untuk itulah, kemampuan bahasa dari segitiga pemangku kepentingan yang digambarkan oleh Antonio Gramsci, yaitu negara (state), pasar (market), dan masyarakat sipil (civil society), menjadi faktor determinan untuk memperkuat daya saing Indonesia di berbagai bidang.

Selain bahasa Inggris yang telah mendunia, Perserikatan Bangsa-Bangsa telah menetapkan bahasa resmi yang digunakan dalam forum-forum internasional dengan bahasa Prancis, China, Rusia, Spanyol, dan Arab. Lalu kemana peran bahasa Indonesia yang penggunanya lebih dari 230 juta umat manusia di muka bumi?

Kita tak perlu merasa risih karena tak lama lagi bahasa Indonesia setidaknya akan disahkan menjadi bahasa resmi ASEAN. Alasan utamanya, selain digunakan oleh ratusan juta bangsa Indonesia sendiri, bahasa Indonesia sedikit banyak juga digunakan dan dipahami oleh sebagian masyarakat dari negara-negara di Asia Tenggara. Terlebih lagi, beberapa negara maju di luar kawasan Asia Tenggara, misalnya Australia, juga sudah memiliki pusat bahasa pengajaran dan kurikulum tentang bahasa Indonesia.

DEFENDING THE DIRECT GUBERNATORIAL ELECTION

The political reformation in 1998 has significantly transformed the democratization atmosphere in Indonesia through amendment of the 1945 Constitution. One of its fundamental changes is related to the electoral mechanism on regional leaders for Governors, Regents and Mayors. We used to have indirect election where the regional leaders were chosen by members of local parliament. A year after the enactment of Law Number 32 Year 2004 of Regional Government, the election of regional leaders was changed to direct election which uses one person one vote mechanism.

On the other hand, six years after its implementation, many Indonesians are questioning whether the mechanism of direct election is still appropriate with the aims of democracy itself since it creates economic, social and political burdens. Responding to this condition, the Government has just proposed a bill of local elections which one of its provisions intends to change back the present gubernatorial election into indirect election through local parliament. As a result, this issue has attracted a lot of debate not only among politicians but also between government officers and academicians. This essay will consider some objections to the Government planning to change the gubernatorial election system. Finally, it will put forward a number of reasons why the direct gubernatorial election in Indonesia should not be changed.

In the context of Indonesian political history, several different systems of local election have been implemented. Firstly, the central government appointed the local leaders (pre independence era – 1958); Secondly, the President directly appointed the local leaders (1959-1973); Thirdly, the local parliament nominated candidates of local leaders to the President and they would be decided by the President (1974-1998); Fourthly, the local parliament chose the local leaders without any involvement from central government (1999-2003); Lastly, people elect their own local leader directly through one man one vote mechanism (2004 – present).

PEMILIHAN UMUM DAN MONETOCRACY

“Money Politics dan Shadow State adalah dua elemen yang membajak makna dan proses demokrasi atas nama uang”.

Demokrasi kerap dijadikan kambing hitam oleh sebagian kalangan atas tumpah ruahnya kebebasan yang kadang sulit dikendalikan. Demokrasi juga acapkali dipersalahkan atas tidak jelasnya arah perbaikan kondisi bangsa ini. Bahkan semenjak ribuan tahun yang lalu, demokrasi sudah terbaca belangnya oleh para filsuf dan guru etika seperti Plato, Aristoteles, ataupun Socrates.

Menurut mereka, demokrasi dapat melahirkan para kaum demagog, yaitu para orator ulung yang senang merayu, bersikap baik sesaat, dan menjual mimpi-mimpi utopis agar rakyat memilihnya. Namun setelah terpilih, rakyat dilupakan. Topeng-topeng semu itu kemudian dipakai kembali pada masa pemilihan selanjutnya (Focke, 1839).

Bergulirnya reformasi konstitusi yang dimulai sejak 1999 sampai dengan 2002 telah mengubah kehidupan bangsa Indonesia secara fundamental. Konfigurasi tata negara yang berubah dan kian berkembang telah pula melahirkan tumbuh suburnya beragam teori dan praktik sistem ketatanegaraan terbaru. Tidak sulit sebenarnya untuk menemukan hal-hal tersebut. Apabila kita hunting ke toko buku maka puluhan literatur dan buku seputar hukum tata negara akan nampak berderet memenuhi rak-rak kategori bidang hukum. Jikalau ingin mencari teori yang lebih spesifik lagi maka perpustakaan hukum menjadi alternatif tempat yang harus dituju.

Artinya, banyak sudah literatur hukum tata negara yang dengan mudah dapat kita temukan sekarang ini. Namun di antara varian buku hukum tata negara itu, sepertinya baru ada satu buku teks Hukum Tata Negara yang diterbitkan secara komprehensif dengan menggunakan medium bahasa Inggris, yaitu “The Constitutional Law of Indonesia” karya Prof. Dr. Jimly Asshiddiqie, S.H.
