About Pan Mohamad Faiz, S.H., M.C.L., Ph.D.

Pan Mohamad Faiz was born in Jakarta, Indonesia. He earned his PhD on Constitutional Law at the TC Beirne School of Law, the University of Queensland in Brisbane, Australia. Faiz has been working as a Researcher, Judicial Assistant and Speechwriter at the Indonesian Constitutional Court since 2005. He has a Bachelor of Laws degree from the University of Indonesia and Master of Comparative Laws degree, concentrating in comparative constitutional law, from the University of Delhi where he was fully supported by ICCR Scholarship. He has been invited to be a guest lecturer on constitutional law at the Faculty of Law, University of Indonesia and other Indonesian legal institutions since 2008. He was the Executive Secretary of the Expert Council of Indonesian Legal Scholars Association (ISHI) and a Legal Researcher at the Institute of Indonesian Law and Governance Development (IILGD) and at the Legal Center for Law and Information (The CeLI). In 2012 he became a Research Scholar at the Centre for Public, International and Comparative Law (CPICL) and commenced his PhD at TC Beirne School of Law, the University of Queensland. Early 2012 the U.S. Department of State awarded Faiz a premier professional exchange program known as the International Visitor Leadership Program (IVLP) for his outstanding achievement and contribution. Despite his achievement in academic area, Pan Mohamad Faiz is well known as a student activist both in national and international level. He was the President of Student Senate at Faculty of Law, University of Indonesia (2004-2005) and the President of Indonesian Student Association in India/PPI-India (2007-2008). He is also one of the founders of “Forum Lintas Generasi (FLG, Depok), Overseas Indonesian Students Association Alliance (OISAA, Sydney), and Institute of Indonesian Law and Governance Development (IILGD, Jakarta). Faiz also served as National President of Indonesian Students Association of Australia (PPI Australia) and Coordinator of Overseas Indonesian Students Association Alliance (PPI se-Dunia).

Prabowo fights on, but Indonesian court ruling ends legal challenge

As many analysts predicted, Indonesia’s Constitutional Court (MK) has rejected losing presidential candidate Prabowo Subianto’s challenge to the election result.

Despite the decision, which is final and binding, Prabowo has yet to concede defeat and congratulate Joko Widodo, who is better known as Jokowi, on winning.

Through the State Administrative Court, his legal team is still challenging the legality of the Jakarta governor Jokowi running for the presidency. Probowo’s coalition is also planning to set up a special committee in parliament to question the election process and result.

Whatever he does, though, the Constitutional Court ruling is clear. Prabowo lost. Continue reading

Audio Q&A: Prabowo’s appeal to the Constitutional Court

International leaders have begun congratulating Indonesia’s president-elect Joko Widodo. But losing candidate Prabowo Subianto is yet to concede defeat.

After a dramatic withdrawal from the vote-counting process hours before the Election Commission (KPU) announced the official result on Tuesday, Prabowo’s legal team announced on Wednesday their plans to challenge the KPU’s decision.

Prabowo claimed there had been a massive, structured and systematic fraud in the election. To establish this before the court, the burden of proof is on Prabowo.

Pan Mohamad Faiz, a PhD candidate in constitutional law, said Prabowo would have “a very hard time to prove before the court” that irregularities in the election rendered the result invalid.

Majalah_81_Majalah Edisi Juni 2014 _Page_01Amandemen UUD 1945 yang dilakukan dalam empat tahapan pada 1999 sampai dengan 2002 telah banyak mengubah substansi dari UUD 1945 yang asli. Salah satu perubahan fundamental yang terjadi adalah pemuatan atas jaminan hak-hak asasi manusia ke dalam UUD 1945 yang sebagian besar diadopsi dari Universal Declaration of Human Rights (UDHR). Jaminan hak-hak sipil dan politik (Sipol) di dalam UUD 1945 berkesesuaian dengan International Covenant on Civil and Political Rights (ICCPR), seperti hak untuk hidup, hak menyatakan pendapat, hak untuk tidak disiksa, hak atas perlindungan hukum yang adil, dan sebagainya. Sementara itu, hak-hak ekonomi, sosial, dan budaya (Ekosob) di dalam UUD 1945 sejalan dengan International Covenant on Economic, Social and Cultural Rights (ICESCR), misalnya hak untuk bekerja, hak untuk memperoleh kesehatan, hak untuk mengenyam pendidikan, dan hak untuk penghidupan yang layak.

Walaupun terdapat jaminan hak Ekosob bagi warga negaranya, Indonesia sebagai salah satu negara berkembang memiliki banyak tantangan dan hambatan dalam pemenuhan hak-hak tersebut. Misalnya, masih tingginya tingkat kemiskinan, rendahnya tingkat pendidikan, dan minimnya akses air bersih bagi penduduk. Salah satu upaya yang dilakukan oleh pelaku amandemen UUD 1945 guna melindungi hak konstitusional warga negara adalah dengan dibentuknya Mahkamah Konstitusi (MK). Pemberian kewenangan pengujian undang-undang (judicial review) terhadap MK diharapkan menjadi salah satu mekanisme untuk pemenuhan hak-hak Ekosob.
